What North Carolina Families Should Know
Immigration bonds are federal
North Carolina does not determine eligibility or set the amount. These federal custody decisions belong to DHS or ICE and, when permitted, an immigration judge.
Release from a local jail may lead to ICE custody
Under North Carolina General Statutes §162-62, a person may remain temporarily in local custody when the facility receives a matching ICE detainer and administrative warrant. Unless another process requires detention, release must occur when the first of these happens: 48 hours pass from when the person otherwise would have been released; ICE takes custody; or ICE withdraws the detainer.

Applications and supporting documents can generally be handled electronically.
Submit the approved bond
After verification, payment and underwriting, Amistad submits it electronically.
ICE processes the bond, and the detention facility coordinates release. Release timing is not guaranteed.

Amistad does not charge annual maintenance fees. Premium and application fees are separate from collateral, and all collateral is subject to approval. For property collateral, ownership, mortgages, liens, taxes, documents and signatures must be verified. Vacant land, commercial property and rental property are not accepted.
Collateral return or lien release begins after ICE formally cancels the bond, no valid breach remains and contractual obligations are complete.
Confirm the Current Detention Location
A person transferred from a North Carolina jail may be held in another county or state. Use the ICE Inmate Locator guide and confirm the current facility before starting the bond process.
ICE lists the Alamance County Detention Center in Graham, but it is not the only possible detention location.
The Charlotte Immigration Court has administrative control over documents issued by the North Carolina and South Carolina DHS sub-offices. Not every case or bond hearing takes place there; follow the official hearing notice.
