- DHS or an Immigration Judge determines the bond.
- Release does not end the immigration case.
- Immigration bond and criminal bail are separate.
New York Operational Reality
- The arrest location may not be the detention location.
- ICE may transfer the detained person.
- The facility, ICE office and court may be in different places.
- Confirm the current location before traveling.
What If a Bond Has Not Been Set?
You can still call if the amount is unknown. Amistad can review the available information and explain what would be needed if an eligible bond is established.
We cannot set, reduce or appeal a bond decision. If the person needs to request a bond hearing or challenge a 'no bond' determination, speak with an immigration attorney.

For approved New York applications
The full cash collateral is separate from the premium and application fee.
After ICE formally cancels the bond without declaring it breached, the person who provided the collateral may request its return. Amistad must verify the cancellation and confirm that all contractual obligations have been satisfied. The premium and application fee are not refundable.
New York Property Is Not Accepted
Amistad does not accept property located in New York as collateral for its immigration surety bond program. This is an Amistad program requirement.
If the proposed home is in another state, ask an agent whether a property review is available for that location.

Finding Someone in ICE Custody
Use the official ICE Detainee Locator to search with the person's A-Number and country of birth. If the A-Number is unavailable, try the full name, date of birth and country of birth.
A recent detention may not appear immediately, and a transfer can change the listed location. Confirm the current facility before making travel arrangements.
